Hotel GrandBach
Sendai Accommodation Terms and Conditions

(Scope of Application)

Article 1: 1. The accommodation terms and conditions and related contracts concluded between Hotel GrandBach Sendai (hereinafter referred to as “the Hotel”) and guests shall be governed by these Terms and Conditions. Matters not provided for herein shall be governed by laws and regulations or generally established customs.
2. If the Hotel accepts a special agreement within the scope that does not violate laws and regulations or customs, such special agreement shall prevail notwithstanding the preceding paragraph.

(Application for an Accommodation Contract)

Article 2: 1. A person seeking to apply for an accommodation contract with the Hotel shall provide the following information. In applying, the applicant shall do so after agreeing that these Accommodation Terms and Conditions shall constitute the contract terms.

  1. Guest name
  2. Accommodation date and scheduled arrival time
  3. Accommodation charges (in principle, based on the basic accommodation charge in Appendix Table 1).
  4. Other matters deemed necessary by the Hotel

2 If the guest requests to extend the stay beyond the accommodation date set forth in item (2) of the preceding paragraph during the stay, the Hotel shall treat such request as an application for a new accommodation contract at the time the request is made.

(Formation of the Accommodation Contract, etc.)

Article 3: 1. The accommodation contract shall be concluded when the Hotel accepts the application set forth in the preceding article; however, this shall not apply if the Hotel proves that it did not accept the application.
2. When the accommodation contract is concluded pursuant to the preceding paragraph, the guest shall pay, by the date specified by the Hotel, an application deposit determined by the Hotel up to the amount of the basic accommodation charge for the accommodation period (or 3 days if the period exceeds 3 days).
3. The application deposit shall first be applied to the accommodation charges ultimately payable by the guest; if a case arises to which Article 6 and Article 17 apply, it shall then be applied in the order of cancellation charges and then compensation, and any remaining balance shall be refunded at the time of payment of charges under Article 11.
4. If the guest fails to pay the application deposit in Paragraph 2 by the date specified by the Hotel pursuant to that paragraph, the accommodation contract shall lose its effect. This shall apply only if the Hotel has notified the guest to that effect when specifying the due date for payment of the application deposit.

(Special Provision That No Application Deposit Is Required)

Article 4: 1. Notwithstanding Article 3, Paragraph 2, the Hotel may accept a special agreement that no application deposit is required after the contract is concluded.
2. If the Hotel did not request payment of the application fee mentioned in Paragraph 2 of the preceding Article or did not specify a payment due date when accepting the application for the accommodation contract, it shall be treated as having agreed to the special contract mentioned in the preceding paragraph.

(Refusal to Enter into an Accommodation Contract)

If a guest cancels all or part of the accommodation contract due to reasons attributable to the guest (excluding cases where the Hotel, pursuant to Article 3, Paragraph 2, has specified a due date for the application deposit and requested payment, and the guest cancels the accommodation contract before making such payment), the Hotel will charge a cancellation fee as set forth in Appendix Table 2. However, where the Hotel has accepted a special agreement under Article 4, Paragraph 1, this shall apply only if, in accepting such special agreement, the Hotel has notified the guest of the obligation to pay a cancellation fee in the event the guest cancels the accommodation contract.
3. If a guest does not arrive by 9:00 PM on the day of stay without contacting the Hotel (or, if an expected arrival time has been specified in advance, by the time that is 2 hours after such specified time), the Hotel may treat the accommodation contract as having been canceled by the guest.
